At the GNSO Council meeting held on November 20, 2003, a motion carried unanimously appointing Amadeu Abril I Abril, as an independent Council member, to the WHOIS task force 2 on Review of Data Collected and Displayed.

Jordyn Buchanan proposed working on the timeframe along the milestones as set out by Thomas Keller.

Milestone 1

a.) Extract and comment RAA provisions relevant to registrant notification and consent regarding data collection and processing.

To be done by: ICANN Staff - [one week]

b.) Contact the top 10 registrars (and their resellers) to document implementation of these provisions.
Staff survey of registrars and the disclosures on their website, with the addition of a select group of resellers

To be done by: ICANN Staff, Top 10 Registrars - [week of 12/22]

Questions to be prepared by next call December 15, 2003

c.) Request statements from registrars [1/1]

d.) Public comments relating to outliers [4 January, 2004]

Milestone 2

a.) Documentation of all relevant data elements.

Comment from Kathryn Kleiman:
I renew my call in Milestone 2 for a second round of public comment to "c) New additional data fields." It is impossible to respond to a suggestion that has not yet been made. Some constituencies will make suggestions for new data fields. Others will need to respond. Consistent with other "reply comment periods," the second round can be much briefer than the first round. In addition, we are not talking about public comment, but returning to the Constituencies. Overall, a brief and narrow reply comment period is called for here.


Milestone 3

a) Examine technical mechanisms to limit or differentiate data.

Request input from task force 1, and then determine if follow up.
NOTE: fact-finding for 4d) likely required first.

Milestone 4

a.) Documentation and commentary of existing methods of "proxy" registrations or mechanisms providing anonymous presentation of data, and their policies for allowing review and disclosure of domain name registration information.

To be done by: ICANN Staff led, but not limited to suppliers, Constituencies, CCNSO, GAC [Jan. 15]

b.) Extract and comment Registrars Accreditation Agreement (RAA) provisions relevant to WHOIS access. (Encompass all the relevant sublicensing of names.)

To be done by: ICANN Staff - should be done by ICANN legal Counsel

c.) Documentation of local privacy laws with the help of the GAC and the CCNSO and also using existing legal compilations and commentary.

To be done by: ICANN Staff, GAC, CCNSO, existing legal compilations and commentary; public comment

d) Technical means available to registrars and registrants to allow registrants to remove data elements from public access.

To done by:

- outreach to task force #1, and
- technical fora .

Most data gathering should be back by January 15, 2004
