1) Status of other data gathering efforts - Survey - Data compilations (OCED, Epic, etc)
Barbara Roseman reported that the surveys to the Registrars, the GAC and ccNSO had not been sent out. The problem was how to get back easy to tabulate questionnaires but there was no solution found. The task force suggested that the responses be made available publicly and that the questionnaires be published on the GNSO website.

It was felt that the OECD report as well as the work of the previous Whois survey results would be useful background information.
Barbara Roseman proposed posting the links to the mailing list.
Kathy Kleiman offered to post the EPIC documents viz:

Kathy Kleiman emphasised that governmental comments that had been received should be studied.
Thomas Roessler proposed sending the link on the IWGDPT's common position on WHOIS.

February 16 date for task force survey responses.

2) Discussion of steps after data gathering is complete
Jordyn Buchanan commented that it was envisaged that the ICANN staff would compile the data but task force involvement with the process was perhaps desirable in view of the work load.
Amadeu Abril I Abril suggested that the data be divided up by data fields or comments coming from different parties.

Barbara Roseman suggested that the ICANN staff could perhaps create documents that put similar answers together so that the data could then be more easily analysed.
Marilyn Cade asked whether the questionnaires would be machine readable, and emphasized the necessity of developing a standard form to classify the data for analysis.
Jordyn Buchanan suggested identifying several data analysis teams focussed by subject area.
Thomas Roessler mentioned that it was possible to read the OECD report through a browse feature.
Kathy Kleiman commenting on the amount of lengthy reports/treatises that needed to be interpreted stated that it was a huge job and that statutory interpretation required legal skills. The question was whether ICANN had the legal resources to provide these skills to the task forces.
Marilyn Cade from experience working on the United States Government and the European Commission, commented that the determination of the laws were up to the country and not to a third party.
Evaluation of the laws and their applicability to the Whois led to a discussion on whether there should be lawyers advising the task force which was felt not to be a good idea.
Barbara Roseman suggested asking the opinion of ICANN General Counsel, John Jeffrey and coming back to the task force with an answer by February 4 or next Whois task force 2 call on February 9, 2004

1. Jordyn Buchanan suggested appointing 3 teams to analyze the data on:
- government policies and regulations, feedback from the GAC.
- analysis of registrar responses
user experience
